Constitutional Court refuses to interpret the military training for reservists

The Constitutional Court rejected the request by the Council of Ministers for an interpretation of provisions of the Constitution to decide whether the introduction of compulsory military training for reservists under the Armed Forces Reserve Act is permissible. The government should itself decide the conflict between two laws, whether it is permissible to introduce peacetime compulsory training for reservists. 

The Council of Ministers asked whether the constitutional provision allows for the introduction of compulsory peacetime training of reservists without it leading to the reintroduction of compulsory military service for Bulgarian citizens in the form that existed before January 1, 2008.  According to the report on the state of defense and the Armed Forces in 2022, the vacant places in the army are 19.7% of the staff. The shortage of officers is 23.4%, of sergeants- 10.9% and of soldiers- 24.2%.
