President Radev refers article from Radio and Television Act to Constitutional Court

Bulgaria’s President Rumen Radev referred to the Constitutional Court a request for binding interpretation of an article from the Radio and Television Act. According to this article, the decision of the Bulgarian National Assembly and the decree of the President to define members of the Council for Electronic Media enter into force simultaneously, although the Bulgarian President and the Bulgarian National Assembly renew their quotas in different periods. The Bulgarian President believes that this is not consistent with the idea behind the rules of the structure of the Council for Electronic Media and leads to inadequate regulation of public relations. According to Bulgaria’s head of state, the article violates the principle of separation of powers and mandate as fundamental principles in the constitution and functioning of public authorities.
