Initial court mediation now mandatory in number of judicial proceedings

The National Assembly has approved, definitively, amendments to the Mediation Act which are an element of the National Recovery and Resilience Plan.

The court will, from now on, be able to obligate the sides in a pending case to take part in a first meeting as part of the mediation procedure. The sides can take part in mediation once during the legal proceedings.

The court will be able to require mediation when an application for divorce has been submitted under the Family Code; in the resolution of custody disputes and issues connected with the place of domicile, personal relations with the child and alimony. Mandatory mediation is waived in disputes between parents over travel abroad by the child and the issuance of personal documents for the purpose
