Constitutional Court rejects claim against US AP 1000 reactors

The Constitutional Court has rejected the claim by MPs from the Bulgarian Socialist Party and Vazrazhdane to declare unconstitutional the decision of the 48th National Assembly for holding negotiations on the construction of a new AP 1000 unit at Kozloduy NPP. The court session was attended by 10 constitutional judges, and the ruling was endorsed by 8 votes. Atanas Semov and Yanaki Stoilov attached a dissenting opinion.  

On 12 January, the decision was approved in parliament by the MPs from GERB/SDS, the Movement for Rights and Freedoms, Democratic Bulgaria, Bulgarian Rise and one independent MP. The members of parliament from Vazrazhdane and the Bulgarian Socialist Party voted against, We Continue the Change abstained. According to the Bulgarian Socialist Party and Vazrazhdane, the decision runs counter to the principle of the separation of the executive from the legislature, and by designating the US technology, is in violation of the requirement for competition.
