Bulgaria cannot issue European arrest warrants

The Court of Justice of the European Union in Luxembourg has ruled that the Bulgarian Prosecutor's Office cannot issue European arrest warrants. The reason is that the Bulgarian legislation does not provide for judicial control of the European arrest warrant and the detention order for up to 72 hours. According to the European magistrates, in this situation the procedural rights of the wanted persons were not guaranteed.

The decision is related to a case of a person wanted for theft in this country and found in the UK, but will have an effect of precedent related to all wanted Bulgarians in the EU, BGNES reports.
